How to Appeal an Administrative Decision

If you wish to appeal a final City administrative decision, or if you are requesting reconsideration of a Hearing Examiner decision, you must file your request through the City’s Online Permit Center using the Appeal of an Administrative Determination application.

Appeal and reconsideration deadlines are established by the Lakewood Municipal Code and vary depending on the permit and type of decision.

Your deadline will either be stated in your notice or decision or established by the specific code section referenced in the notice or decision.

If you are unsure of your deadline, contact the individual listed on your notice before the deadline passes.

  • Appeal: Any aggrieved or affected party of record.
  • Request for Reconsideration: Any party of record from the original Hearing Examiner proceeding.

For an Appeal, your written Notice of Appeal must include:

  1. The name of each person or party filing the appeal.
  2. The permit number or the decision, or part of the decision, being appealed.
  3. An explanation of each appellant’s legal interest in the decision.
  4. The specific action you disagree with and the facts supporting your position.
  5. What you are asking the Lakewood Hearing Examiner to do.
  6. A copy of the signed decision or notice you are appealing. You may also upload any other supporting documentation.

For Reconsideration of a Hearing Examiner Decision, your written request must identify the specific errors you believe were made involving procedure, law, fact, or judgment, or describe new evidence that was not reasonably available at the time of the public hearing.

All administrative appeals must be submitted through the City’s Online Permit Center.

  1. Sign in to the Online Permit Center. If you do not have an account, follow the How to Sign Up for an Online Permit Center Account guide.
  2. Start a new application and select Appeal of an Administrative Determination. For step-by-step instructions, see How to Submit a Permit Application.
  3. Upload all required documents, including your Notice of Appeal and a copy of the decision being appealed.
  4. Pay the filing fee. Fees are established by the City’s current fee schedule. For assistance to pay fees online, see How to Pay Permit Fees in the Online Permit Center.

Your administrative appeal is not considered complete until all required information and documents have been submitted through the Online Permit Center and all required fees have been paid.

Contact your project contact or the contact listed on your notice for assistance.
