ARPA Project Eligibility

Potential American Rescue Plan Act (ARPA) award recipients should assess how their intended use of ARPA funds responds to or addresses the negative economic impacts of the COVID-19 emergency.

The specific eligible uses listed below are non-exclusive. Projects which respond to or address the negative economic impacts of the COVID-19 emergency will be considered.

List of eligible uses for ARPA funds

(A) SUPPORT PUBLIC HEALTH EXPENDITURES
To respond to the public health emergency or its negative economic impacts, including assistance to households, small businesses, and nonprofits, or aid to impacted industries such as tourism, travel, and hospitality; 

  • COVID-19 mitigation and prevention services
  • Medical expenses
  • Behavioral health care
  • Public health and safety staff
  • Expenses to improve the design and execution of health and public health programs

(B) PREMIUM PAY FOR ESSENTIAL WORKERS
To respond to workers performing essential work during the COVID–19 public health emergency by providing premium pay to eligible workers; 

  • Staff at nursing homes, hospitals, and home care settings
  • Workers at farms, food production facilities, grocery stores, and restaurants
  • Janitors and sanitation workers
  • Public health and safety staff
  • Childcare workers, educators, and other school staff
  • Social service and human services staff

(C) REPLACE LOST PUBLIC SECTOR REVENUE
For the provision of government services to the extent of the reduction in revenue due to the COVID–19 public health emergency relative to revenues collected in the most recent full fiscal year prior to the emergency; and

  • Category (c) is for government entities to calculate lost revenue due to the COVID-19 emergency.

(D) NECESSARY INVESTMENTS IN WATER, SEWER, OR BROADBAND INFRASTRUCTURE
To make necessary investments in water, sewer, or broadband Infrastructure. In addition, Congress clarified two types of uses that do not fall within these four categories. Sections 602(c)(2)(B) and 603(c)(2) provide that these eligible uses do not include, and thus funds may not be used for, depositing funds into any pension fund. Section 602(c)(2)(A) also provides, for States and territories, that the eligible uses do not include ‘‘directly or indirectly offset[ting] a reduction in the net tax revenue of [the] State or territory resulting from a change in law, regulation, or administrative interpretation.’’

  • Water and sewer infrastructure projects
  • Broadband infrastructure projects

Qualified Census Tracts

Qualified Census Tracts (QCTs) are census tracts that have been determined by HUD to be disproportionately impacted by the COVID-19 emergency.

ARPA allows for a broad range of uses to address the disproportionate public health and economic impacts of the crisis on the hardest-hit communities, populations, and households. Some projects automatically qualify as eligible uses of ARPA funds when serving populations located within QCTs.

Lakewood’s Qualified Census Tracts include:

  • 718.05 – Lakeview
  • 718.06 – Springbrook
  • 718.08 – Monta Vista
  • 720.00 – Tillicum and Woodbrook

List of eligible uses for ARPA funds within QCTs

(A) FACILITATING ACCESS TO RESOURCES THAT IMPROVE HEALTH OUTCOMES

  • Funding community health workers
  • Funding public benefits navigators
  • Housing services to support healthy living environments and wellness
  • Remediation of lead paint or other lead hazards
  • Evidence-based community violence intervention programs

(B) RESPONDING DIRECTLY TO THE ECONOMIC HARMS RESULTING FROM AND OR EXACERBATED BY THE PUBLIC HEALTH EMERGENCY

  • Assistance to unemployed workers, such as job training
  • Contributions to state unemployment trust funds
  • Assistance to households
    • Food assistance
    • Rent
    • Mortgage
    • Utility assistance
    • Counseling and legal aid to prevent eviction or homelessness
    • Cash assistance
    • Emergency assistance for burials
    • Home repairs
    • Weatherization
    • Internet access
    • Digital literacy assistance
  • Expenses to improve the efficacy of economic relief programs
  • Small business and non-profitsLoans and grants to mitigate financial hardship
    • Loans, grants, or in-kind assistance to implement COVID-19 prevention or mitigation tactics
    • Technical assistance, counseling, or other services to assist with business planning needs
    • Rehiring state, local, and tribal government staff
    • Aid to impacted industries such as:
      • tourism
      • travel
      • hospitality

(C) BUILDING STRONGER COMMUNITIES THROUGH INVESTMENTS IN HOUSING AND NEIGHBORHOODS

  • Services to address homelessness such as supporting housing
  • Affordable housing development
  • Housing vouchers, residential counseling, or housing navigation assistance to facilitate household moves to neighborhoods with high levels of economic opportunity and mobility for low-income residents

(D) ADDRESSING EDUCATIONAL DISPARITIES

  • New, expanded, or enhanced early learning services
  • Providing assistance to high-poverty school districts to advance equitable funding across districts and geographies
  • Evidence-based education services and practices to address the academic needs of students including:
    • tutoring
    • summer school
    • after school
    • other extended learning and enrichment programs
  • Evidence-based practices to address the social, emotional, and mental health needs of students

(E) PROMOTING HEALTHY CHILDHOOD ENVIRONMENTS

  • New or expanded high-quality childcare to provide safe and supportive care for children
  • Home visiting programs to provide structured visits from health, parent educators, and social service professionals to pregnant women or families with young children to offer education and assistance navigating resources
  • Enhanced services for child welfare-involved families and foster youth

Guidelines and Reporting Requirements

ARPA Final Rule

The U.S. Department of the Treasury has released its final rule for ARPA. As of April 1st, 2022, all ARPA activity must adhere to the provisions of the Final Rule. ARPA activity before April 1st, 2022 can be measured using the Interim Final Rule or the Final Rule.

Document and Information Retention Requirements

In order to be eligible to accept an ARPA award, your organization must be able to abide by the rules and regulations set out by the U.S. Department of the Treasury. Any award of ARPA funds by the City of Lakewood is a subaward of ARPA State and Local Fiscal Recovery Funds (SLFRF); the Subrecipient is subject to any and all compliance requirements and reporting requirements for use of and for expenditure of SLFRF funds.

The Subrecipient shall comply with E-Verify as set forth in Lakewood Municipal Code Chapter 1.42

Performance of this Agreement is subject to review by any Federal, State, or County auditor, including a single audit for Subrecipients receiving more than $750,000 as required by the American Rescue Plan Act and related guidance from the Department of the Treasury.

The City or its designee shall have the right to review and monitor the financial and service components of this program by whatever means are deemed expedient by the CITY.

Financial and Reporting Records must be kept for 5 years after the end of the ARPA Program, or until at least December 31st, 2031.
